These Terms and Conditions apply to all purchases made from Allisons Home & Garden (“we”, “us”, “our”). They are designed to be clear, fair, and compliant with UK consumer law, while reflecting how we operate as a builders’ merchant and supplier of landscaping and ready-mix products.


1. Definitions

  • Company: Allisons Home & Garden.
  • Customer / You: The person or business purchasing Goods from us.
  • Consumer: An individual purchasing Goods wholly or mainly outside their trade, business, craft or profession.
  • Business Customer: Any Customer who is not a Consumer, including trade and credit account customers.
  • Goods: Any products supplied by us, including building materials, landscaping products, and ready-mix products.
  • Order: A request by you to purchase Goods from us, whether online, by phone, email, or in person.
  • Acceptance: Our confirmation that we have accepted your Order.
  • Writing / Written: Written communication including email.
  • Custom or Made-to-Order Goods: Goods mixed, cut, assembled, or prepared specifically to your requirements (including part pallets and ready-mix products).

2. Contract Formation

2.1 Our website, price lists, and brochures are invitations to treat and do not constitute a binding offer.

2.2 A legally binding contract is formed only when we confirm Acceptance of your Order, as set out in clause 2.14.

2.3 By placing an Order, you confirm that:

  • You are legally capable of entering into a contract;
  • You are at least 18 years old;
  • You are resident in the United Kingdom;
  • The information you provide is accurate and complete; and
  • You accept these Terms and Conditions.

2.4 Any advice provided by us is based on the information you supply. You are responsible for ensuring that Goods are suitable for your intended use.

2.5 Any variation to these Terms must be agreed in Writing by an authorised representative of Allisons Home & Garden.

2.6 We take reasonable care to keep our website, price lists and order confirmations accurate. If a clerical, typographical or pricing error occurs, we may correct it before your Order is accepted, without any liability on our part.

2.7 Where a member of our team places an Order on your behalf — for example, over the phone or in-store — it is your responsibility to check that the order confirmation is correct before we proceed.

2.8 You are responsible for obtaining any planning, access or local authority permissions needed for delivery or installation of the Goods before placing your Order.

2.9 Our website is intended for customers based in the United Kingdom, and we are only able to deliver within the areas set out in Section 7.

2.10 Where Goods are to be prepared to a design, drawing or specification you supply, you must ensure that information is accurate and provide it to us in enough time for us to fulfil your Order.

2.11 Where Goods are prepared to a specification, design or drawing you supply (for example, a bespoke cut or made-to-order item), you confirm that you are entitled to use that specification, and you agree to be responsible for any reasonable losses, costs or claims we directly incur as a result of that specification infringing the intellectual property rights of a third party.

2.12 We may make reasonable changes to the specification of Goods where necessary to meet a legal or safety requirement, or where Goods are supplied to your specification and the change would not materially affect their quality or performance.

2.13 All Orders are subject to availability and to our Acceptance.

2.14 Unless we have agreed credit or trade account terms with you in Writing, payment in full for the Goods and any applicable delivery charge is taken at the time you place your Order. Receipt of payment in full is what triggers preparation and dispatch of your Order. Acceptance takes place — and a binding contract is formed — when we dispatch the Goods, or notify you that they are ready for collection, whichever happens first. Taking payment does not by itself amount to Acceptance, and if we are unable to fulfil your Order we will notify you and refund any payment taken in full.

3. Prices and Payment

3.1 Prices are shown inclusive of VAT unless stated otherwise.

3.2 Prices may change at any time prior to Acceptance of your Order.

3.3 Full payment is required before Goods are released for delivery or collection.

3.4 We reserve the right to amend prices after Acceptance where required due to circumstances beyond our control (for example, material cost increases). If this occurs, you will have the option to cancel and receive a full refund.

3.5 Prices shown per unit or per m² are based on the purchase of a full pack or full unit. Where we agree to split a pack or supply individual sizes or quantities, an additional charge applies to reflect the extra opening and handling involved, and the price will be confirmed with you before Acceptance.

3.6 All deliveries are chargeable — we do not offer free delivery. Collection from our yard is free of charge. Delivery charges are quoted at checkout or confirmed with you directly, and depend on the size, weight and distance of your Order.

3.7 Our standard delivery charges apply to addresses within our normal delivery area, details of which are available on our website or on request. Deliveries outside that area are priced on application (POA): longer-distance Orders are sent through a specialist pallet network and are quoted individually, so please contact us for a delivery quote before placing your Order.

3.8 For the avoidance of doubt, all prices are shown in pounds sterling (£).

3.9 Payments may be processed through approved third-party payment providers. Any refund relating to a payment made through such a provider will normally be processed through the same provider.

4. Custom and Ready-Mix Products

4.1 Custom and made-to-order Goods (including ready-mix products) are prepared specifically for your Order and cannot be cancelled once production has begun.

4.2 Ready-mix products are supplied fresh and are non-returnable once collected or delivered.

5. Cancellation by You

5.1 If you are a Consumer, you may cancel your Order for standard (non-custom) Goods within 14 days of receipt in accordance with the Consumer Contracts Regulations.

5.2 Returned Goods must be unused, in original packaging, and in resaleable condition.

5.3 You are responsible for return transport and costs. A reasonable restocking fee may apply.

5.4 This right to cancel does not apply to bespoke, special-order, imported-to-order, or Custom or Made-to-Order Goods, as set out in Section 4.

5.5 Once returned Goods have been received and inspected, we will process your refund to the original payment method, normally within 14 days. We may reduce the refund if Goods are returned damaged, or show signs of use beyond what’s reasonably needed to inspect them.

5.6 To exercise your right to cancel, please notify us in Writing, including by email.

5.7 If Goods have already been delivered, you must return them within 14 days of telling us that you wish to cancel.

5.8 Where Goods are faulty or were supplied incorrectly, we will cover the cost of return; in all other cases, return costs are as set out in clause 5.3.

5.9 Where it is more practical, we may arrange collection of the Goods on your behalf and deduct the collection cost from your refund.

5.10 Longer-distance orders are delivered through a specialist pallet network, and any return of those Goods will also be by pallet network due to their size and weight. The return transport cost — including any associated handling charges — may be significant and will be confirmed with you before collection is arranged. Once Goods have left our premises or entered the delivery network, cancellation may not be possible without incurring this cost.

5.11 The cancellation rights in this Section apply to Consumers only. Business Customers have no right to cancel an Order under this Section once it has been Accepted, except as agreed by us in Writing. This does not affect any rights or remedies in respect of faulty or misdescribed Goods.

6. Cancellation by Us

We reserve the right to cancel an Order if:

  • Goods are unavailable;
  • Pricing or listing errors occur;
  • Delivery or collection cannot be reasonably fulfilled; or
  • Fraud or payment issues are suspected.

Any payments made will be refunded in full.

7. Delivery

7.1 Delivery dates are estimates only.

7.2 Delivery is kerbside to the nearest safe and accessible point.

7.3 You are responsible for ensuring suitable access and presence at delivery.

7.4 Failed or aborted deliveries may incur additional charges.

7.5 Goods should be checked on delivery where possible. Any shortage, damage or discrepancy must be reported within the timeframe set out in clause 7.7, or, if you are a Business Customer, clause 12.4.

7.6 Estimated delivery times are provided in good faith and may be affected by matters outside our control, including supplier delays, traffic or weather. We recommend not booking a contractor or landscaper to begin work until your Goods have been delivered and inspected — we are unable to cover labour, contractor or project-delay costs resulting from a late or delayed delivery.

7.7 Please inspect your delivery as soon as possible, and in any event within 72 hours. If you’re not able to check everything at the time of delivery, please sign the delivery note as “Unchecked” rather than signing it as received in good condition. Any shortage, damage or discrepancy should be reported to us within that time, ideally with photographs, so we can look into it promptly. Please keep hold of packaging until the Goods have been checked. This does not affect your statutory rights regarding faulty or misdescribed goods.

7.8 Delivery is made to the nearest safe point on or adjacent to the public highway. The final decision on where a delivery can safely be made always rests with the driver, whose judgement on access and safety is final. If you ask the driver to take the vehicle or the Goods beyond the public highway — for example onto a driveway, verge or private land — this is done at your own risk, and we will not accept liability for damage to property (including driveways, paths, drains, kerbs or lawns) caused as a result.

8. Collection

8.1 Some Goods are available for collection only.

8.2 Collection prices include VAT but exclude delivery.

8.3 You must arrange suitable transport and loading assistance where required.

8.4 Risk transfers to you once Goods are loaded or collected.

9. Risk and Ownership

9.1 Risk passes to you upon delivery or collection.

9.2 Ownership remains with us until payment is made in full.

10. Quality, Inspection and Natural Variation

10.1 Many products are manufactured from natural materials and may vary in colour, texture, and appearance between batches. Product photographs and samples are a guide only, and exact colour matching cannot be guaranteed.

10.2 Samples are indicative only.

10.3 Installed Goods are deemed accepted, as set out in clauses 10.5 to 10.7.

10.4 For the best finished result, we recommend laying paving using slabs drawn from multiple packs rather than working through one pack at a time, and ordering enough material for your whole project at the outset, as later top-up orders may not exactly match the original batch.

10.5 Please check Goods for any visible defects and report these to us before installation or laying begins.

10.6 Installing or using the Goods confirms your acceptance of any visible defect that would reasonably have been identified by checking the Goods beforehand, as set out in clause 10.5. This does not affect your statutory rights in relation to faulty Goods or defects that could not reasonably have been spotted before installation.

10.7 Once Goods have been installed, we cannot accept responsibility for removing or relaying them, or for any associated labour costs, except where this results from our own breach of these Terms or from a defect that could not reasonably have been identified before installation.

11. Liability

11.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.

11.2 We are not liable for indirect or consequential losses, including loss of profit or business.

11.3 Save as set out in this Section, our liability for any claim relating to Goods supplied is limited to the value of the Goods in question.

11.4 This includes, without limitation, contractor fees, labour costs, installation costs, project delays or loss of earnings arising from any issue with an Order.

11.5 Nothing in these Terms affects your statutory rights.

12. Business Customers

12.1 This Section applies where you are a Business Customer.

12.2 We do not warrant that Goods are suitable for any particular purpose. It is your responsibility to satisfy yourself that the Goods are fit for your intended application before ordering.

12.3 Where applicable, Goods are sold with the benefit of the manufacturer’s warranty or guarantee.

12.4 Any shortage, damage, defect or incorrect delivery must be notified to us in Writing within 24 hours of delivery or collection.

12.5 As set out in clause 5.11, Business Customers have no right to cancel an Accepted Order except as agreed by us in Writing.

13. Health & Safety

Customers must follow safe handling practices, including the use of protective equipment and correct lifting methods.

14. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018.

15. Cookies

Our website uses cookies in line with our Cookie Policy.

16. Notices

16.1 Any notice or formal communication under these Terms should be sent in Writing to Allisons Home & Garden, 24A Cambridge Street, Castleford WF10 5BL, or by email to info@allisonssupplies.co.uk. We will send notices to the postal or email address you provide with your Order.

17. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control.

18. Severability

If any part of these Terms is found by a court or other competent authority to be invalid or unenforceable, that part will be treated as deleted to the minimum extent necessary, and the remainder of these Terms will continue in full force and effect.

19. Governing Law

These Terms are governed by English law and subject to the exclusive jurisdiction of the English courts.

20. Entire Agreement

These Terms constitute the entire agreement between you and Allisons Home & Garden.
